JUNE 2006 - Customer Notification Letter
TO: PURCHASERS OF FANLIGHT, INC. MERCURY VAPOR LAMPS AND METAL HALIDE LAMPS
RE: NOTIFICATION OF PRODUCT DEFECT (per 21 C.F.R. § 1003.21)
All models of the following products are affected by this notice:
PLUSRITE POWERSTRIKE METAL HALIDE LAMP
PLUSRITE LOW WATT METAL HALIDE LAMP
PLUSRITE UNIVERSAL METAL HALIDE LAMP
PLUSRITE PROTECTED METAL HALIDE LAMP
PLUSRITE MERCURY VAPOR LAMP
- Nature of Product Defect.
Please be advised that these products are defective for failure to comply with the Food and Drug Administration’s (FDA’s) regulations governing these products. 21 C.F.R. § 1040.30. The Company is taking steps to bring all such products into compliance with these regulations.
- Potential Health Hazards.
The lack of required markings and warnings on these lamps may contribute to, or exacerbate, injuries that may be sustained from breakage of the outer bulb and resulting exposure of persons to shortwave ultraviolet radiation. The injuries from such exposure can include eye and skin injuries.
- Disposition of Affected Lamps and Offer for Free Replacement.
Fanlight will, without charge, remedy the defect or bring the product into compliance with each applicable Federal standard in accordance with the following replacement plan, described below. As a part of this offer for a free replacement lamp, you are requested to return the lamp(s) currently in your possession to Fanlight.
Therefore, Fanlight, Inc. will, at no charge to you, remedy the defect by offering each purchaser of a defective lamp a replacement lamp that complies with the federal standards. To obtain a replacement, please complete the attached form. In order for us to process your return and send a replacement, you must complete this form and return to Fanlight any PlusRite lamps in your possession.

If you don’t have any defective product, please complete the form and mail it to Fanlight. (Please use the return envelope.) |
Please include the original sales receipt or invoice, if available. Upon receipt of your lamp(s), we will send to you a replacement lamp that complies with the applicable federal regulations at no cost to you within 30 days of receipt, if we have product in stock. If we are awaiting an incoming shipment from our factory, we will send the replacement lamp as soon as we are in stock.
Please furnish a copy of this notice and form to each customer of yours that may have purchased any of the lamps in question. Further, please ask each of your customers to forward the notice to its customers, and so on down the chain, to assist the Company with its goal of notifying the ultimate user/consumer of our mercury vapor and metal halide lamp products. We will contact you shortly to follow up.
